Terms of Sales

The general conditions of sale detailed below (hereinafter referred to as "the General Conditions of Sale" or "the GTC") govern the contractual relations between any user of the site https://www.nature-spring.com -after designated "the Client" or "You") and the President of the Company M.7.H. Productions, registered at the RCS Toulon under the number 83082995800016, domiciled at 18 avenue Frederic Mistral 83500 The seyne-sur-mer (hereinafter referred to as "the Seller").

Article 1: General Provisions
The Seller markets wellness products (hereinafter referred to as "the Product" or "the Products").

These General Conditions of Sale apply to all sales of Products, made through the site https://www.nature-spring.com (hereinafter referred to as "the Site").

The Seller reserves the right to modify these, at any time, by publishing a new version on the Site. The applicable GTC then are those in force on the date of payment (or the first payment in case of multiple payments) of the order.

The Seller makes sure that the acceptance of the GTC is clear and unreserved, by setting up a checkbox and a validation click.

You declare that you have read all of these General Conditions of Sale and, where applicable, the Special Conditions of Sale related to a Product, and accept them without restriction or reservation.

By ordering on the Site, you acknowledge having the necessary advice and information to ensure the suitability of the Product to your needs.

You declare to be able to contract legally under French law or validly represent the natural or legal person for whom you agree. Unless proven otherwise, the information recorded by the Seller constitutes proof of all transactions.

Article 2: Products and services
The essential characteristics of the Products and their prices are available on the Site.

The Seller agrees to honor your order within the limit of available stock at the time of purchase.

You certify that you are informed in detail of any delivery charges and the terms of payment, delivery and performance of the contract.

This contractual information is presented in detail and in French. In accordance with French law, they are the subject of a summary and a confirmation during the validation of your order. The period of validity of the offer of the Products as well as their prices is specified on the Site.

Article 3: Price
The prices of Products sold through the Site are indicated in euros excluding taxes and specifically determined on the product descriptions pages. They are also indicated in euros without VAT (VAT not applicable, article 293B of the CGI - Company not subject) on the invoice, and excluding specific shipping costs.

For all Products shipped outside the European Union and / or DOM-TOM, the price is calculated excluding taxes automatically on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable in certain cases. These rights and sums are not the responsibility of the Seller. They will be the responsibility of the Customer and are his responsibility (statements, payment to the competent authorities, etc.). The Seller invites the Customer to inquire about these aspects with the corresponding local authorities.

The Seller reserves the right to change prices at any time for the future. Delivery charges are your responsibility, unless otherwise stated on the product description pages.

Article 4: Conclusion of the contract on line
To place an order on the site, you must at least go through the following steps:

Consultation of the card presenting a photograph (a Product);
Entering your customer information (identity, address, delivery address ...);
Acceptance of these General Terms of Sale;
Verification of the elements of the order and, if necessary, correction of the errors;
Followed instructions for payment, and payment of Products.
You will then receive an acknowledgment of receipt confirming the order, as well as a confirmation by e-mail of the payment of the order.

For the purpose of order fulfillment, and in accordance with Article 1316-1 of the Civil Code, you agree to provide truthful identification.

The Seller reserves the right to refuse an order, for example for any abnormal request, made in bad faith or for any illegitimate reason.

Article 5: Terms of delivery
The Products are delivered to the delivery address you specified when ordering.

Delivery is made within the indicative deadlines specified on the website https://www.nature-spring.com, and at the latest within 8 working days following the order, except in case of force majeure.

You will receive an email informing you of the shipment of your order, to which will be attached the invoice for your order.

In case of late delivery, you can cancel your order under the terms and conditions defined in Article L 138-2 of the Consumer Code. The Seller then refunds you the Product and the delivery costs, under the conditions of Article L 138-3 of the Consumer Code.

In the order confirmation message, you will find an e-mail address to which you can contact the Seller to track your order.

As a reminder, when you physically take possession of the Products, the risk of loss or damage to the Products is transferred to you. It is your responsibility to notify the carrier of any reservation on the Delivered Product.

Article 6: Payment
Payment is due immediately upon order. You can pay by credit card or Paypal account. Cards issued by banks domiciled outside France must be international credit cards (such as Mastercard or Visa).

Secure online payment is made:

via the Stripe platform if you pay by credit card,
via the Paypal platform if you pay by Paypal account.
Your bank details are encrypted. They do not circulate in clear on the Internet and can not be intercepted. They are not communicated to the Seller.

Once the payment has been initiated by the Customer, the transaction is immediately debited after verifying the information. In accordance with Article L. 132-2 of the Monetary and Financial Code, the commitment to pay given by card is irrevocable. By providing your bank details at the time of the sale, you authorize the Seller to debit your card with the amount relating to the price indicated. You confirm that you are the legal owner of the debit card and that you are legally entitled to use it. In case of error, or inability to debit the card, the sale is immediately resolved automatically and the order canceled.

Article 7: Withdrawal period
In accordance with Article L. 121-20 of the Consumer Code, you have a right of withdrawal to return a product that does not suit you.

Following an order on the Site, you have a period of 14 calendar days to make a return request. For this, please send an email to contact@nature-spring.com, following which the Seller will contact you to tell you the terms of return and the address of the place of return.

Products returned without their original packaging, or incomplete, damaged or soiled by the Customer will not be taken back.

After receipt of the returned product, the Seller will refund by transfer the price of the Product, excluding shipping and return costs that are your responsibility.

Article 8: Guarantees
In accordance with the legal provisions regarding conformity and hidden defects, the Seller refunds or exchanges the defective Products or does not correspond to the order. Please report the defective or non-compliant nature of a Product, by email to: contact@nature-spring.com, following which the Seller will agree with you an exchange or a refund. The Seller will also refund the cost of returning the defective or non-conforming Product.

Article 9: Claims
If you are not satisfied with a product or service, you can send a complaint by email to contact@nature-spring.com

Article 10: Protection of personal data
In accordance with the Data Protection Act of 6 January 1978, you have the right to query, access, modify, oppose and rectify your personal data.

By adhering to these general conditions of sale, you consent to the Seller collecting and using this data for the performance of this contract.

Article 11: Intellectual property rights
Trademarks, domain names, products, software, images, videos, texts or more generally any information subject to intellectual property rights are and remain the exclusive property of M.7.H Productions. No assignment of intellectual property rights is carried out through these GSC. Any total or partial reproduction, modification or use of these goods for any reason whatsoever is strictly prohibited.

Article 12: Retention of title clause
The Products remain the property of the Seller until full payment of the price.

Article 13: Force majeure
The performance of the Seller's obligations hereunder shall be suspended in the event of the occurrence of a fortuitous event or force majeure that would prevent its execution. The Seller will notify the customer of the occurrence of such an event as soon as possible.

Article 14: Nullity and modification of the contract
If one of the stipulations of the present contract were canceled, this nullity would not entail the nullity of the other stipulations which will remain in force between the parts. Any contractual modification is valid only after a written agreement signed by the parties.

Article 15: Applicable Law
All clauses contained in these general conditions of sale, as well as all the purchase and sale operations referred to therein, will be subject to French law.
